Liens - County, Federal, State, Hospital and Mechanic's Liens

COUNTY LIENS: These liens are for financial assistance that the individual has received through the county. The lien can be for a court appointed attorney, public defender, mental health services, poor relief etc. The county is allowed by law to attach these liens to any property that someone may own at the time the lien is taken against them or acquires after the lien was filed.

FEDERAL AND STATE LIENS: State and federal tax liens recorded with the Register of Deeds office include state sales and excise tax liens, etc. If you request a search and written response for a federal tax lien, there is a $20.00 search fee, per lienee name, or a $15.00 search fee, per lienee, if a verbal response is requested.

You may use the form entitled "Request for Federal Tax Lien Search" if you wish to request a search, and provide it to the Register of Deeds Office at 415 N. Dakota Ave., Sioux Falls, South Dakota, 57104. Please also include a money order, made payable to the Register of Deeds, in the amount of the required fee. HOSPITAL LIENS: Hospital Liens are filed with the Register of Deeds. This type of lien is filed by a hospital or other medical care facility.

MECHANIC’S LIENS: A mechanic’s lien is filed against real property when work has been performed or material provided and payment has not been made.
